Arbicon ADR - Expert Reports
Arbicon can provide Expert Reports where an opinion is sought on a construction related problem or dispute, which may then lead to further proceedings depending on the outcome of the report.
A party to any construction contract seeking an opinion or further evidence by commissioning an expert report from Arbicon, if they are justified in their claims, will be well placed contemporaneously should the matter proceed formally to ADR or court proceedings.
Such parties might include:
• Building Employers (Client or Developer)
• Main Contractors
• Sub-Contractors
• Householders
• Insurance Companies
Any commercial or domestic contract dispute can be reported on by Arbicon, who are regulated by the Practice Statement issued by the Royal Institution of Chartered Surveyors for the purpose of Expert Reports.
The Expert Report for any contract problem will take account of the contract and the arguments and evidence produced by both parties. The Expert Report will give a defined outcome and the view given will also be fair and impartial.
All construction sectors are covered including building and civil engineering industries plus specialist areas such as water, rail, housing, insurance, mechanical and electrical industries.
Matters reported on can be any commercial matter including all aspects of Quantity Surveying and valuations, interpretation of contract and the law, delay analysis, programmes, disruption, loss valuation, insurance valuation, professional negligence, defective works and insolvency.
Expert Witnesses
In all forms of proceedings, it is not unusual for a court or arbitrator to
seek an expert from a construction
profession or specialism.
Arbicon can act as a tribunal’s appointed expert and provide expert
witness evidence to assist the tribunal
in resolving a dispute between
parties. Arbicon may be appointed as
single joint expert or as party expert
providing their specialised opinions
to the tribunal, whether this is in
adjudication, arbitration or the courts.
Expert Determinations
Parties to a dispute are generally free
to agree how they would like their
dispute decided and can agree to
appoint a joint expert with additional
powers to decide the dispute. Arbicon
have the skilled professionals capable
of acting in an expert determination.
